Michael Jordan Tells Court He Felt No Fear of the Racing Body in Antitrust Trial
Michael Jeffrey Jordan, introducing himself formally in a Charlotte court on Friday, admitted that his competitive side and status as a newcomer emboldened his effort with 23XI Racing to “challenge” Nascar over alleged violations of competition laws.
Team Investment and a Competitive Drive
Jordan shared operational insights of his racing venture, revealing he put in $40 million of his own funds into the Nascar Cup series team launched with partner Polk and driver Hamlin.
“Someone had to step forward,” Jordan said during testimony. “As a newcomer, I wasn’t afraid. I felt I could challenge Nascar in its entirety. From my perspective, the sport required examination from a different view.”
Central Issue: Franchise System and Renewal Demands
The heart of the case involves the expiration of a 2016 deal where Nascar granted each team a “charter”. The concept is similar to other professional sports with separately owned franchises, like the Charlotte Hornets or the NFL’s Panthers. This deal was set to expire in 2024 when Nascar insisted on teams renew their charters.
Jordan was on the witness stand for about sixty minutes and exited the courthouse to pandemonium, with onlookers and reporters vying for a glimpse or a photo of the sports legend.
Spearheading the Fight
Jordan’s 23XI is leading the full-court press along with another racing team for Nascar to change a operating model Jordan said is unlawful to maintain excessive control.
At issue for Jordan and Heather Gibbs, who preceded Jordan, are details from last September. She recounted a hectic and tense six hours where the sanctioning body told teams they had to sign a contract extension. A Refusal to Sign

Heather Gibbs detailed her request for permanent charters, which she said a written letter to Nascar. She testified the pressure of the signature deadline didn’t sit well.
She said, Joe Gibbs first tried to call and persuade Nascar against demanding signatures, but CEO Jim France declined the request.
“Don’t do this to us,” Heather Gibbs said Joe Gibbs told Nascar’s leadership. The response was, “Whether I have 20 charters, I have 20. If I have 30, I have 30.”
