US Court Orders Freedom of Kilmar Abrego Garcia from Immigration Custody

A court has ordered the prompt discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued detainment is without legal authority.

"Since his release after wrongful detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her order.

The case originates in a erroneous removal to El Salvador earlier this year, which US authorities later admitted was an error. After his return to the United States to answer alien smuggling charges, he was held in immigration custody.

In her decision, the court pointed out that the government does not have a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "at this time."
